This Privacy Policy explains our collection and use of information that may identify you through our virtual try on service (“CTFit”), and through emails, text messages, direct messages, or other communications whether electronic or written (all of the above is referred to collectively as the “Service”). It is Couture Technologies’ policy to respect your privacy regarding any information we may collect, subject to the terms and conditions of this Privacy Policy and the Terms of Use (“Terms”), as either or both may be amended from time to time.

We reserve the right to change this Privacy Policy from time to time and at any time, without notice, within the sole, independent, absolute and uncontrolled exercise of its discretion. By checking the Effective Date above, you can determine the date of our latest changes to this Privacy Policy. We encourage visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of the Service after any change in this Privacy Policy will constitute your acceptance of, and consent and agreement to, such change.

We collect the following information about you:

Personal Information

“Personal Information” is information that directly or indirectly identifies you, such as your name, email address, or other identifying information about you, or that would, when combined with other information you provide or that is broadly available, be likely to identify you.

Other Information

“Other Information" is information that is not Personal Information, that is, by itself, it does not individually identify you, such as browser type, operating system, technical data, and usage. Like most website and application operators, we collect Other Information of the sort that web browsers, applications and servers typically make available to operators, like the browser type, language preference, referring site, and the date and time of each visitor request. We may use this information for a number of purposes including, for example, to better understand how visitors use our Service. The purposes for collecting and using this data may change from time to time at our discretion, and we may release non-Personal Information in the aggregate. We may also link together different types of Other Information or link Other Information to Personal Information. By utilizing CTFit, you agree to such use.

3.    How We Collect Information

Information provided by you 

We collect information that you provide us directly. To use CTFit, you will need to provide us with measurements of your body and/or images of you, which may be identifiable. We will delete these photos automatically after creating your avatar and save a black and white silhouette derived from the photos. If you create a CTFit account profile (the “Profile”) we may request Personal Information such as your name, contact information, age, gender, size, and fit preferences. You may also provide us with Personal Information through any website or mobile application provided to you by Couture Technologies or controlled by a Couture Technologies retail partner. Couture Technologies retail partners are third parties for whom Couture Technologies provides its Service. When accessing the Couture Technologies Service through a Couture Technologies retail partner, the Personal Information you provide through the retail partner's website or mobile application (“Partner Site”) will be subject to the retail partner's privacy policy; however, this Privacy Policy will apply to those aspects of your Personal Information that are provided to Couture Technologies in order to perform the Service.

Information automatically collected

While you use the Service, we automatically record certain information. This information includes: 

Computer, tablet, or mobile telephone information. We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers, device sensors and mobile network information including phone number) and device sensors and related information. We may associate your device identifiers or phone number with your account. We will comply with the usage/license restrictions and requirements applicable to the device from which the information comes.

Log information. When you use the Service or view content provided by us, we may automatically collect and store certain information in server logs. This may include, for example:

• details of how you used our Service.

• Internet protocol address.

• device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.

We use the information we collect to provide you with the Service or to provide the Service through our Partner Sites, to provide you with a superior customer experience, and to administer our business. We use your Personal Information to:

• Provide the Service;

• Create and provide recommendations on size, fit, and style of apparel items;

• Analyze the fit, style, and fashion of apparel items;

• Create a Profile (personal account) you can log into from any device;

• Provide you with special offers, promotions, and other marketing programs and news that may be of interest to you;

• Answer questions you ask of us regarding the Service or recommendations;

• Make communications necessary to notify you regarding security, privacy, and administrative issues;

• To operate, evaluate and improve our business and the products and services we offer;

• To analyze and enhance our marketing communications and strategies;

• To analyze trends and statistics regarding visitors’ use of our Service including mobile applications and social media assets;

• To protect against and prevent fraud, unauthorized transactions, claims and other liabilities; and

• To improve our customer service.

Other Information is used as described above and in other ways as permitted by applicable laws, including combining Other Information with Personal Information.

5.    How We Share Information We Collect

Service Providers, Retail Partners, and other Affiliates.

Couture Technologies may share a copy of your Profile, which may include your email address (if provided) with: (i) our retail partners, so they can better personalize apparel offerings to you; (ii) service providers, subcontractors, and agents who perform services on our behalf; (iii) manufacturers of products sold on our Partner Sites to provide insights relating to the fit, style, and purchase preferences relating to their products; and (iv) third parties in certain business relationships, such as, but not limited to, co-branded offerings where we may offer a service or feature that is co-branded by Couture Technologies and the third party. If you provide Personal Information in connection with a co-branded service or feature, that Personal Information may be shared between Couture Technologies and the third party. Couture Technologies’ treatment of that Personal Information is governed by this Privacy Policy, but the third party's treatment of your Personal Information will be subject to the third party’s privacy policy.

Couture Technologies discloses Personal Information to those of its employees, contractors, agents and affiliated organizations that need to know that information in order to process it on our behalf or to provide services. Some of those employees, contractors, agents and affiliated organizations may be located outside of your state, province or country. By using the Service or providing us information, you consent to the transfer of such information to them.

Business Transfers

In the event (i) Couture Technologies engages in one more asset sales or purchases, (ii) Couture Technologies is acquired, (iii) Couture Technologies engages in one or more business combinations, mergers or acquisitions, (iv) substantially all of Couture Technologies’ assets are acquired, or (v) Couture Technologies is subject to an event of bankruptcy, you acknowledge and agree that user information comprises an asset of Couture Technologies and that the same is subject to assignment, transfer and/or acquisition by a third party. Accordingly, and notwithstanding anything to the contrary in this Privacy Policy, you acknowledge and agree that such transfers may occur, and that any acquirer of Couture Technologies may continue to subsequently use your Personal Information, and that such subsequent use may not be consistent with this Privacy Policy.

Couture Technologies may share aggregated or de-identified information for our business purposes.

6.    How We Protect Your Information

We take commercially reasonable security measures, including physical, technological, and procedural measures, to help to safeguard your Personal Information and to prevent unauthorized access and disclosure. No method of transmission over the Internet, or method of electronic storage, however, is 100% secure. Therefore, we cannot guarantee its absolute security.

In some cases, we cannot control, and are not responsible for, information that is shared about you. For example:

Information You Share. Some of aspects of the Service may let you share information with others. Remember that when you share information publicly, it may be indexable by search engines or otherwise further disclosed. 

Social Media Accounts. Couture Technologies maintains various social network accounts such as Facebook, Twitter or LinkedIn. Please note that comments and information that you leave in such settings are likely to be broadly visible and may not be controlled by Couture Technologies. We are therefore not responsible for any information or messages you leave in such settings or for how such information may be used by others. Please review the terms of use and privacy policies of any social network platforms you use, as they will control your rights and responsibilities, and your use of those platforms is not covered by this Privacy Policy.

International Visitors

We operate globally and may transfer your Personal Information and Profile to individual companies and customers of Couture Technologies as part of the Services offered by Couture Technologies to its customer base. Wherever your Personal Information is transferred, stored, or processed by us, we will take reasonable steps to safeguard the privacy of your Personal Information. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring information about you, including Personal Information, to a country and jurisdiction that does not have the same data protection laws as the country in which you reside, and you consent to the transfer of information about you, including your Personal Information, to the U.S.; and the use and disclosure of information about you, including your Personal Information, as described in this Privacy Policy.

Choices About Your Information

When you interact with our Service in certain ways, you may be eligible to receive certain marketing-related and promotional communications as well as special offers (collectively "Marketing Communications") from Couture Technologies or third parties with whom Couture Technologies has a business relationship and those communications may include advertisements. The most common of these circumstances may include:

• Creating a Profile

• Signing up to receive newsletters or email notices

• Entering a sweepstakes or a contest

If, at any time, you wish to no longer receive Marketing Communications from Couture Technologies, you will be able to follow instructions provided with the Marketing Communication or within our Service in connection with Promotional Communications. Even if you opt-out of receiving Marketing Communications, you may continue to receive e-mails relating to your Profile, Personal Information, and/or other security or business-related communications. 

If you provide us with information or create a Profile, we may or may not be able to provide you with access to your Personal Information. If information that we control about you is incorrect, we strive to give you ways to update it quickly or to delete it (unless we have to keep that information for legitimate business or legal purposes). When updating your Personal Information, we may ask you to verify your identity before we can act on your request.

Children

The Service is not intended for use by children. We do not intentionally gather Personal Information about individuals who are under the age of 13. If a child has provided us with Personal Information, a parent or guardian of that child may contact us to have the information deleted from our records. If we learn that we have inadvertently collected the Personal Information of a child under 13, or equivalent minimum age depending on jurisdiction, we will take steps to delete the information as soon as possible.

Do Not Track Signals

Some browsers have a "Do Not Track" feature that lets you tell websites and online services that you do not want to have your online activities tracked. Such browser features and industry standards are not uniform, so our websites and online services do not respond to those signals.

The Service may contain links to webpages or tools operated by parties other than Couture Technologies. We do not control such websites or tools and are not responsible for their contents or the privacy policies or other practices of such websites or service providers. Our inclusion of links to an outside website or tool does not imply any endorsement of the material on such websites or tools or any association with their operators. Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from our Service or other websites) is free of such items as viruses, worms, trojan horses, defects and other items of a destructive nature. These websites and services may have their own privacy policies, which you will be subject to upon accessing the third party’s website.
